By accessing or using Blinked.in, a business directory website ("the Platform"), provided by Rakesh Kolhapure ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, please refrain from using the Platform.

2. Account Registration and User Obligations

2.1 Account Creation: To access certain features of the Platform, you may need to create an account. You must provide accurate, complete, and up-to-date information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

2.2 User Obligations: You agree to use Blinked.in in a manner consistent with applicable laws and regulations. You further agree not to:

a) Provide false, misleading, or fraudulent information;
b) Impersonate any person or entity or falsely claim an affiliation with any business or organization;
c) Use the Platform for any illegal, unauthorized, or prohibited purposes;
d) Interfere with or disrupt the operation of the Platform or the networks connected to it;
e) Engage in any activity that could harm, disable, overburden, or impair the Platform's functionality;
f) Attempt to gain unauthorized access to any part of the Platform or other users' accounts;
g) Upload or transmit any malicious code, viruses, or harmful content;
h) Engage in any activity that violates the rights of others, including intellectual property rights;
i) Engage in spamming, phishing, or any other form of unsolicited communications;
j) Collect or store personal information of other users without their consent; or
k) Engage in any other activity that we deem inappropriate or that could harm the reputation or integrity of Blinked.in.

3. Subscription Plans

3.1 Available Plans: Blinked.in offers three paid subscription plans: Plus, Prime, and Premium, each with varying features, benefits, and durations.

3.2 Billing: Subscription fees are billed at the beginning of each subscription period.

3.3 Free Trial for 14 Days: Users may enjoy a 14-day free trial with Plus features. Upon completion of the trial period, the subscription will automatically convert to a free plan unless upgrade.

4. Paid Subscription, Refund, Cancellation, and Shipping

4.1 Paid Subscription: Users who opt for a paid subscription plan (Plus, Prime, Premium) will gain access to premium features outlined in each plan.

4.2 Refund Policy: Refunds are available within [15 days] of the subscription purchase, subject to the conditions outlined in this Refund Policy.

Refund Conditions:

▪ Refunds are only applicable within 15 days of the initial subscription purchase.
▪ To request a refund, users must submit a refund request through the designated process on the platform.
▪ Refunds will not be granted for subscription periods that have already elapsed.
▪ Certain fees, such as setup fees [SmartAssist], may be non-refundable.

4.3 Cancellation: Users can cancel their subscription by following the cancellation procedure outlined on the platform. Cancellation within the contract period may be subject to fees as specified in the subscription plan.

4.4 Online Services: The nature of our services is primarily online. Users acknowledge and agree to the digital nature of the services provided.

4.5 Shipping (if applicable): For tangible items (if applicable), refer to our shipping policy. Shipping costs, if any, will be clearly communicated during the checkout process.

5. Business Listings and Content

5.1 Business Listings: Blinked.in allows businesses and service providers to create and manage business listings on the Platform. You are solely responsible for the accuracy, completeness, and legality of the information provided in your business listing. By creating a business listing, you grant us a non-exclusive, worldwide, royalty-free license to display and promote your business information on Blinked.in.

5.2 Content Ownership: You retain ownership of any content you submit or upload to the Platform, including business information, logos, images, and other materials. By submitting content to Blinked.in, you grant us a non-exclusive, transferable, sub-licensable, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display the content for the purposes of operating and promoting the Platform.

5.3 Prohibited Content: You may not upload, post, or transmit any content that is unlawful, defamatory, obscene, offensive, discriminatory, or otherwise objectionable. We reserve the right to remove or disable any content that violates these Terms or that we deem inappropriate.

6. Intellectual Property

6.1 Blinked.in Content: The Platform and its content, including but not limited to text, graphics, logos, images, software, and design elements, are owned or licensed by us and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any portion of the Platform without our prior written consent.

6.2 User Content: Blinked.in respects the intellectual property rights of others and expects its users to do the same. If you believe that your copyrighted work has been infringed upon, please contact us with the necessary information to initiate a review and potential removal of the infringing content.

7. Third-Party Links and Services

7.1 Third-Party Websites: Blinked.in may contain links to third-party websites that are not owned or controlled by us. We do not endorse or assume any responsibility for the content, privacy policies, or practices of these third-party websites. You access and use these websites at your own risk.

7.2 Embedded Services: The Platform may incorporate embedded services provided by third parties, such as mapping services or social media widgets. Your use of these embedded services is subject to the respective third-party terms and policies. We are not responsible for the availability, functionality, or security of these embedded services.

8. Limitation of Liability

8.1 Disclaimer of Warranties: Blinked.in is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Platform will be error-free, uninterrupted, or free from viruses or other harmful components. You agree to use the Platform at your own risk.

8.2 Limitation of Liability: In no event shall Blinked.in be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you, if any, for accessing the Platform during the twelve-month period preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Blinked.in, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any rights of another party.

We reserve the right to modify or terminate the Platform or these Terms at any time, with or without notice. We may also suspend or terminate your access to the Platform if we believe you have violated these Terms or engaged in any activity that is harmful to the Platform or its users.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the use of Blinked.in shall be subject to the exclusive jurisdiction of the courts located in Mumbai.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and Blinked.in regarding the use of the Platform and supersede any prior agreements or understandings, whether written or oral.

14. User Reviews and Ratings

Blinked.in may introduce a user review and rating feature where users can provide feedback on their experiences with businesses listed on the platform. By submitting a review, users agree to provide honest and accurate information based on their personal experiences.

15. User Responsibilities

Users are responsible for verifying the accuracy and legitimacy of the information provided by businesses listed on Blinked.in. We encourage users to exercise their judgment and conduct their research before engaging with any listed business.

16. Availability of Services

Blinked.in strives to provide uninterrupted access to the platform. However, we do not guarantee continuous availability and reserve the right to temporarily suspend or terminate access to the platform for maintenance, upgrades, or any other necessary reasons.

17. Business Listing Modifications

Businesses listed on Blinked.in have the ability to update and modify their listing information. It is the responsibility of the business owner or authorized representative to ensure that the information remains accurate, up-to-date, and compliant with applicable laws and regulations.

18. Modification of Terms

We may update or modify these Terms from time to time to reflect changes in our services or legal requirements. Any modifications will be effective upon posting the revised Terms on Blinked.in. Users are encouraged to review the Terms periodically for any updates.

19. Data Privacy

Blinked.in is committed to protecting the privacy of user data. Our Privacy Policy outlines how we collect, use, and safeguard personal information. By using Blinked.in, users agree to the collection, use, and disclosure of their personal information in accordance with the Privacy Policy.

23. Reservation of Rights

Blinked.in reserves all rights not expressly granted in these Terms. This includes the right to modify, suspend, or terminate the platform or any features, as well as the right to enforce these Terms to the fullest extent permitted by law.

“However, this terms of services will not apply in the event of the occurrence (Certified by the National Centre for Disease Control, Directorate General of Health Services, Ministry of Health and Family Welfare, Government of India) of a widespread viral infection transmitted via bites or contact with bodily fluids that causes human corpses to reanimate and seek to consume living human flesh, blood, brain or nerve tissue and is likely to result in the fall of organized civilization.”
